We have implemented rigorous policies and procedures to ensure that personal information is handled responsibly and in full compliance with applicable data protection laws. This Policy outlines how GEMtrust DAO manages data protection and personal information in connection with Gem DiCom.

Through these measures, GEMtrust DAO strives to ensure the security and privacy of all Participant data, while maintaining full compliance with applicable regulatory requirements.

1. Data Collection and Usage:

1.1 GEMtrust DAO collects personal data strictly necessary for Participants to participate in Gem DiCom and to comply with applicable legal and regulatory requirements. This data may include name, contact details, identification documents, and transaction-related information. Data collection processes are designed to be transparent, and personal information is used exclusively for participation management and legal compliance purposes.

1.2 Collected data is used primarily for participation management, transaction processing, security measures, and Participant support. GEMtrust DAO may also use data to communicate essential updates or information directly related to a Participant's participation in Gem DiCom. Personal information will not be shared with third parties without a Participant's explicit consent, except where required by applicable law or regulation.


2. Data Security Measures

2.1 GEMtrust DAO utilizes institutional-grade security protocols to protect Participant data from unauthorized access, disclosure, alteration, or destruction. This includes data encryption, secure server infrastructure, and regular security audits to maintain the integrity of all systems and data storage.

2.2 Participants are solely responsible for maintaining the security of their own access credentials and account information. GEMtrust DAO is not liable for any losses arising from a Participant's failure to maintain appropriate security measures for their credentials.

2.3 Our partners, including those responsible for the institutional custody of underlying gemstone assets, are contractually required to adhere to strict confidentiality and data security standards. GEMtrust DAO regularly reviews and audits all partners to ensure compliance with applicable data protection requirements.


3. Transparency and User Control

3.1 Participants have the right to access and control their personal data held by GEMtrust DAO. GEMtrust DAO maintains procedures enabling Participants to request information about stored data, correct inaccuracies, or request deletion of their data where legally and operationally permissible. 3.2 GEMtrust DAO is committed to being transparent about its data policies, regularly reviewing and updating these to reflect any changes in our processes or applicable laws.

4.1 GEMtrust DAO adheres to all applicable data protection laws and privacy regulations in the jurisdictions in which it operates. This includes, where applicable, internationally recognized standards for data protection, to ensure that personal data is processed lawfully, transparently, and with appropriate safeguards. GEMtrust DAO acknowledges its obligations to protect Participant privacy and will act accordingly at all times.

4.2 GEMtrust DAO has implemented technical and operational measures to restrict participation in Gem DiCom from jurisdictions where such participation may be prohibited or subject to enhanced regulatory requirements.


5. Confidentiality

All parties engaged with GEMtrust DAO agree to maintain the confidentiality of proprietary information, financial details, and operational methods disclosed in connection with their participation in Gem DiCom, except where disclosure is required by applicable law or regulation. This confidentiality obligation survives the termination of any participation arrangement or agreement.
